International Adoptions

    International or Intercountry adoptions are governed by three different sets of laws:

 

  • United States federal law,
  • The laws of the child(ren)’s country of birth, and
  • The laws of the state where you reside.

 

    The controllong factor is whether the country is a Convention adoption or non-Convention adoption (orphan adoption) country.  Both the Hague Convention Adoption Process (Convention adoptions) and the orphan adoption process, (or non-Convention adoptions) involve two basic United States determinations:

 

    -  The suitability of the adoptive parents, and

    -  Whether the child meets eligibility requirements in order for the child to immigrate to the United States.


    In determining the suitability of the adoptive parents, a home study is required.  The home study must be submitted to USCIS for all Orphan and Hague adoption cases to determine whether the prospective adoptive parents are suitable and eligible to adopt a child, based on the criteria that have been established by law.
